Acceptance of Terms
The EziMortgage web site (the “Site”) and all services, documents and information provided by EziMortgage Limited (together called the "Service") is provided for New Zealand residents 16 years of age and over.

EziMortgage Limited (“EziMortgage” “we" "us" “our”) makes the Service available on this Site subject to these terms and conditions (the "Terms"). Each time you access the Site and/or make use of the Service, you confirm you have read and agree to the Terms which apply at the time you access the Site. EziMortgage may from time to time amend the Terms.

Description of Service and our role
The Service has been designed to enable the public to access medical insurance information, insurance plans and premium quotations and to apply for your chosen medical insurance plan through our website http://www.mortgage-insurance-nz.co.nz/ online.

EziMortgage is not an insurance broker, an insurance company or your agent. Rather we market insurance products on behalf of insurance companies. EziMortgage has selected the insurance companies because, in our opinion, they provide the best overall quality products available online in the New Zealand marketplace.

Other services may be introduced onto the Site from time to time. These will be notified on the Site prior to implementation. You can use this Site at no charge, however you must:
a.	pay all costs and expenses, including equipment and access charges associated with accessing the Internet;
b.	pay the relevant insurance company the required premium in respect of any insurance plan that you obtain; and
c.	comply with these Terms and the law.

User Obligations
When you use the Service:
a.	all information you provide must be true, accurate, current and complete; and
b.	all answers you provide in response to questions asked must relate to you personally or to the identified person.

If anything you provide is untrue, inaccurate, out of date or incomplete, or if we have reasonable grounds to suspect any of it is untrue, inaccurate, out of date or incomplete, we are entitled to refuse any and all current or future use of the Service (or any portion thereof) and retain all commissions resulting from the introduction of persons to insurance companies. Further, depending on the terms and conditions of the insurance plan you obtain the insurance company may be entitled to cancel your insurance plan, retain the premium or to avoid the insurance plan from inception. The insurance company may have other rights as well.

Modification
We reserve the right to modify the Service with or without notice. We shall not be liable to you, or any third party, in any way should we exercise our right to make modifications.

Acceptable Site Use
The Site can only be used for lawful purposes and only for the purpose for which it is intended. Users are prohibited from violating or attempting to violate the security of this Site. Users must not send unsolicited email messages ("spam") to or through the Site or otherwise harass the Site owner or other users. We are entitled to refuse to deal with any user who violates the law or these Terms.

Our rights
We are entitled to seek all remedies available at law and in these Terms for any violation of these Terms.

Termination
We, in our sole discretion, may terminate your use of the Service or your use of any part of the Service. We can also remove and discard any content within the Service, for any reason. We can do this at any time and without notice We are entitled to immediately delete all information held about you and/or bar you from any further access to the Service.

We are entitled to retain aggregated information which does not identify you personally should your use of the service be terminated. If this Service is terminated we will not disclose identifying information about you to anyone else, except as stated in these Terms.

Applicable Laws
This Site is serviced by us from our offices in Auckland, New Zealand. We do not authorise access to the Service from territories where their contents or use are illegal or prohibited.

This Site, these Terms and the Service are governed by the laws of New Zealand. All disputes in connection with this Site, the Service and these Terms are subject to the nonexclusive jurisdiction of the New Zealand courts.

In this Site references re made to case studies. These are based on actual claims. However, some information has been changed to protect the privacy of the persons involved.

All links and references to other websites, organizations, insurance companies or people not within EziMortgage are provided for the user's convenience only. The links from and to this Site are not under our control. We are not responsible for the contents of any linked website. We do not endorse any of those websites, or any of the information or documentation contained in those websites, nor of organisations, insurance companies or people referred to except where expressly stated.

Dealings with Insurance Providers
Any dealings with any of the Insurance Companies appearing on the Service or participation in promotions, including the delivery of and the payment for goods and services, and any other terms, conditions, warranties or representations associated with such dealings or promotions, are solely between you and the Insurance Company or other third party. EziMortgage is not responsible or liable for any part of any such dealings or promotions. EziMortgage may receive commissions or other remuneration from Insurance Companies in relation to your selection and purchase of insurance or other goods and services from Insurance Companies.

Your acknowledgements
You acknowledge that EziMortgage is not an agent for you or an insurance broker. In particular you acknowledge that:
a.	information and documentation on this Site is provided for informational purposes only and to enable you to make your own choices and judgments concerning any of the goods and services referred to on this Site; and
b.	EziMortgage owes no duties to you, whether in contract, tort (including negligence) at law or otherwise, in relation to the selection of insurance plans or services, arrangement of effective or adequate insurance cover, to advise you in any way in relation to insurance plans or services, or to act in your interests in relation to insurance companies, or otherwise.

If you use our Service for business purposes (or have told or represent to us you will do so) then you agree that to the extent permitted at law the Consumer Guarantees Act 1993 does not apply to the Service.

No warranties and limitation on liability
While we make reasonable efforts to maintain current and accurate information and documentation on this Site, to the extent permitted by law we do not warrant or guarantee:
a.	the accuracy, adequacy, quality, currentness, validity, completeness or suitability of any third party advertisement or the Service, or sent by us for any purpose;

e.	the accuracy, adequacy, quality, currentness, validity, completeness or suitability of any information of documentation provided by an insurance company.

To the extent permitted by law, in no event shall we be liable to anyone for any loss, damage, cost or expense in contract, tort (including negligence), statute or otherwise in connection with:

•	any delays, inaccuracies, errors or omissions with respect to the Service, or
•	the results obtained from the use of, or inability to use, the information or the Service. We will not be responsible if any information infects or contaminates your system or information. The entire risk as to the quality, performance, accuracy, adequacy, completeness, currentness, validity and quality of any information is with you.
